"AN ORDINANCE REPEALING CHAPTER TWELVE (12) ARTICLE TWO (II) OF THE CODE OF ORDINANCES OF THE TOWN OF NORTH PROVIDENCE ENTITLED " PRIVATE DETECTIVE LICENSES" AND AMENDING SAID CHAPTER 12 ARTICLE TWO (II)IN ITS ENTIRETY TO PROVIDE FOR CONCEALED WEAPON LICENSING OR PERMITTING"
IT IS HEREBY ORDAINED BY THE TOWN OF NORTH PROVIDENCE AS FOLLOWS:
SECTION 1. That Article Two (II) of Chapter Twelve (12) of the Code of Ordinances of the Town of North Providence is hereby repealed in its entirety and shall be amended to read as set forth herein.
SECTION 2. That Article Two (II) of Chapter Twelve (12) of the Code of Ordinances of the Town of North Providence shall be entitled "Licensing or Permitting to Carry Concealed Pistol or Revolver"
SECTION 3: That Article Two (II) of Chapter Twelve (12) ?of the Code of Ordinances of the Town of North Providence shall read as follows related to the application and issuance of permits to carry a concealed pistol or revolver:
12-7. No person who is not licensed by the Public Safety Director and/or the Chief of Police to carry a concealed weapon shall carry such weapon.
12-8. Pursuant to the authority granted under Rhode Island General Laws Section 11-47-11, the Public Safety Director
and/or the Chief of Police is/are hereby authorized to accept applications from a North Providence resident seeking to carry a concealed weapon(pistol or revolver) within ?the State of Rhode Island and issue licenses or permits to carry said concealed weapon.
12-9. Any person applying for a local license to carry a concealed weapon shall file a written application for the same, in the form drafted and provided by the Public Safety Director and/or the Chief of Police, with the Public Safety
Director and/or the Chief of Police and comply with the policies and procedures established by the Public Safety
Director and/or the Chief of Police with regard to the processing and investigation of said application(s). The policies and procedures may include the checking of court records and other sources of pending criminal cases,
restraining orders and/or discrepancies in the applicant's background, including prior history of mental illness.
12-10. Any person applying for a local license to carry a concealed weapon shall illustrate a proper showing of need, as required by state law and whether the applicant is qualified.
12-11. The application for a license to carry a concealed weapon shall be accompanied by an application fee of $40.00. The renewal license fee shall be $40.00.
12-12. Any license to carry a concealed weapon issued shall be subject to all applicable provisions of federal and state law.
12-13. Any license issued under this division shall expire four (4) years from the date issued unless sooner revoked.
12-14. Any license to carry a concealed weapon issued may be revoked by the Public Safety Director and/or Chief of Police
at any time, for just cause. Upon revocation, the Public Safety Director and/or Chief of Police shall give immediate notice to the attorney general, who shall immediately note the revocation, with the date of revocation, upon the copy of the license or permit on file in his or her office.
SECTION 4: ALL ORDINANCES OR PARTS THEREOF INCONSISTENT HEREWITH ARE HEREBY REPEALED.
SECTION 5. THIS ORDINANCE SHALL TAKE EFFECT UPON ADOPTION. APPROVED AS TO FORM AND LEGALITY:
